FormPigeon, a SaaS inspection management platform.

The FormPigeon services and Site (collectively, “Form Pigeon Network” or “Form Pigeon Services”) are operated by Form Pigeon Pty Ltd As Trustee for Form Pigeon Unit Trust and its corporate affiliates (collectively, “us”, “we”, “our” or “Form Pigeon”) and are made available through our website or the mobile version (together the “Site”). Your use of the Form Pigeon Services and the Site is governed by these Terms of Service (“Terms of Service” or “Agreement”), whether or not you are a registered subscriber to the Form Pigeon Services or the Site.

1. Your Agreement to Terms of Service

By clicking the box below, you signify that you have read, understand, and agree to be bound by the terms of this Agreement, whether or not you are a registered subscriber. If entering this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms. If you do not have such authority or disagree with these terms, you must not accept this Agreement and may not use the Site or the FormPigeon Services.

FormPigeon reserves the right to modify these Terms of Service with 30 days’ prior notice. Changes will be posted on this page, and continued use of the FormPigeon Services constitutes acceptance of the updated Terms.

2. Payment and Tax

When subscribing to the FormPigeon Services, your credit card will be saved and automatically charged unless the subscription is terminated. Updates to credit card information must be made in the account settings. Failure to process payments may result in subscription termination.

3. Definitions

• “You” and “Your” refer to the individual or legal entity using the FormPigeon Services.

• “Employee” refers to anyone authorized to access the FormPigeon Services on behalf of a client or supplier.

4. FormPigeon Services

FormPigeon reserves the right to modify, suspend, or discontinue any part of the Site or Services with 30 days’ prior notice. Pricing changes will also be communicated 30 days in advance, with an option to terminate the Agreement within that period.

5. Content

You are responsible for evaluating and bearing all risks associated with any Content provided through the FormPigeon Services. FormPigeon is not liable for any inaccuracies, errors, or damages resulting from Content.

6. Third-Party Services

Use of third-party services is subject to their terms. FormPigeon is not responsible for these services but may facilitate payment processing for your convenience.

7. Use of the FormPigeon Services

Access is limited to legitimate business purposes as defined in this Agreement. Unauthorized use, such as copying or redistributing Content, violating laws, or infringing on intellectual property, is strictly prohibited.

8. User Content and Privacy

You retain responsibility for any User Content you provide. By submitting User Content, you grant FormPigeon a license to use, modify, and distribute it for providing services or conducting research. All personal information must be managed in compliance with FormPigeon’s Privacy Policy.

9. Supplier User Content

Supplier User Content may be shared with clients linked to your account. You control access to this list and can request changes or removals at any time.

10. FormPigeon Proprietary Rights

FormPigeon retains ownership of all proprietary technologies, trademarks, and intellectual property associated with its Services.

11. Your Representations and Warranties

You agree to use the FormPigeon Services for lawful purposes and comply with all terms. Misuse, such as reverse engineering or uploading harmful materials, is prohibited.

12. Confidentiality Obligations

You agree to maintain confidentiality for all proprietary information shared through the FormPigeon Services, taking reasonable measures to protect it.

13. Indemnification for Third-Party Claims

You agree to defend and indemnify FormPigeon against any claims, damages, or liabilities arising from your use of the Services.

14. Limitation of Liability

FormPigeon is not liable for indirect, special, or consequential damages. Aggregate liability is limited to the amount paid by you within the 12 months preceding the claim.

15. No Warranties

The Services are provided “as-is” without warranties of any kind. Any implied consumer guarantees are limited to repair or replacement as permitted by law.

16. Termination

Your access to the Services may be terminated for breach of these Terms. Termination does not entitle you to a refund unless required by law.

17. Governing Law

This Agreement is governed by the laws of Victoria, Australia. The United Nations Convention on Contracts for the International Sale of Goods is excluded.

18. Miscellaneous Terms

This Agreement does not create a partnership or agency relationship. Assignments require prior written consent, and any provisions intended to survive termination will remain in effect.

19. Supplemental Terms

Additional terms may apply based on specific uses of the FormPigeon Services, which are incorporated into this Agreement by reference.
